A lot of people have trouble finding a home, condo, or fire insurance policy because their property is located in a wildfire, high brush, or a high fire risk area. If your home is in a canyon, in a high brush area, in a high fire risk zone, in a wildfire area, or close to brush, you may have a hard time finding a home policy, or your home policy may not be renewed. Most of the preferred insurance companies in California will not insure homes if they are in a Wild Fire or Brush Fire area or if there have been multiple losses in the past.
The California FAIR Plan Association (the FAIR Plan) is an association of all insurance companies authorized to transact basic property insurance in California. Established under State law, the FAIR Plan provides insurance coverage to responsible applicants who have been unable to secure insurance for their home or business in the normal market.
Reasonable underwriting standards shall include, but not be limited to, the following:
1. the physical condition of the property, such as its construction, heating, wiring, evidence of previous fires or general deterioration;
2. its present use or housekeeping, such as vacancy, overcrowding, storage of rubbish or flammable materials; or
3. other specific characteristics of ownership, condition, occupancy, or maintenance which are violative of public policy and result in unreasonable exposures to loss.
Neighborhood or area location or any hazard beyond the control of the property owner shall not be deemed to be acceptable criteria for declining a risk.
